BIEGELMEIER, Judge.

This is an action for damages for personal injuries resulting from an automobile accident which occurred June 15, 1967. A summons dated May 25, 1970 and a complaint based on that claim, subscribed by plaintiff's attorneys, were delivered to the sheriff of Roberts County for service on defendants. We are concerned only with defendant Joanne Gruba, hereafter for convenience sometimes referred to as Joanne.
