City of Tulsa v. Fraternal Order of Police, Lodge 93

Court of Civil Appeals of Oklahoma

Decided June 17, 2015No. 111,537Published

1Concurrence

GOODMAN, V.C.J.,

concurring specially.

1 1 But for the limitations contained in the parties' submission to the arbitrator, the arbitrator would have had the power to fashion a remedy in this case. See City of Owasso v. Fraternal Order of Police, 2014 OK CIV APP 75, 8386 P.3d 1023. Accordingly, because the arbitrator decided an issue not submitted for his determination, I agree with the trial court’s order vacating the arbitration award.
