MEMORANDUM AND ORDER

MILLER, District Judge.. The. defendant moves to strike the plaintiffs jury trial demand on the basis of immu nity to trial by jury. For the reasons that follow, the court denies the defendant’s motion to strike the plaintiffs jury demand.

In June 1994, plaintiff Michael Rozak was hospitalized and received a transfusion of blood platelets that he alleges were supplied by the American Red Cross Blood Services (“ARCBS”) and from which he alleges he contracted hepatitis.
