Appeal by the defendant from a finding and award of the Compensation Commissioner of the fifth district acting in and for the first district, in favor of the plaintiff, taken to and tried by the Superior Court in Hartford County, Haines, J.; the court affirmed the award complained of, and from this judgment the defendant appealed.

Two questions arise in this appeal. Did the Superior Court err in dismissing the appeal from the Commissioner and in holding, first, that Kinsman was an employee and not an independent contractor; and second, that the injury resulting in his death arose “out of and in the course of his employment.” The principles of law by which these questions must be decided are settled, and their solution depends upon the application of these rules of law to the facts as found by the Commissioner.
