Plaintiffs own a home in Hood River, Oregon that is currently scheduled for a trustee’s sale. Plaintiffs filed suit against defendants BAC Home Loans Servicing, LP1 (BAC) and ReeonTrust Company, *1320N.A. (ReconTrust) for breach of contract and declaratory relief. Defendants seek dismissal of plaintiffs’ Complaint on the grounds that plaintiffs cannot state a claim for breach of contract and no actionable controversy supports plaintiffs’ request for declaratory relief.
