This matter comes before the Court on Plaintiffs motion for partial summary judgment (Dkt. No. 43) and Defendants’ cross-motion for judgment on the pleadings and/or summary judgment (Dkt. No. 60). Having thoroughly considered the parties’ briefing and the relevant record, the Court hereby DENIES Plaintiffs mo*1098tion for partial summary judgment and GRANTS Defendants’ motion for judgment on the pleadings and/or summary judgment.1
