The decision in this case depends mainly upon the construction that shall be given to the contract declared on. It is, in substance, as follows: In consideration of the sum of $2100 for the year 1873, and $2400 for the year 1874, to be paid in semi-monthly or monthly installments, appellee agreed to devote his whole time and attention solely to the interests of the firm of which it is alleged appellant was a member.
