It is hereby ordered that the order insofar as appealed from is unanimously reversed on the law without costs, the petition is denied, and the matter is remitted to Family Court, Oswego County, for further proceedings in accordance with the following memorandum: Respondent Oswego County Department of Social Services (DSS) appeals from an order that, inter alia, granted the maternal grandmother’s petition seeking sole legal and physical custody of the minor child.
