OPINION

WILKINSON, Circuit Judge:

Appellant Raymond Dayle Rowsey was convicted by a North Carolina jury of first- degree murder on the bases of premeditation and deliberation and felony murder, as well as robbery with a firearm. He was sentenced to death for the murder. After exhausting state remedies, Rowsey petitioned the United States District Court for the Middle District of North Carolina for a writ of habeas corpus under 28 U.S.C. § 2254. The…
