MONTEITH, Chief Justice.

This action was brought by appellant, J. W. Godwin, for the recovery from appel-lee, P. C. Roberts, of a balance alleged to be due him under a contract for the construction of a residence.

He alleged that he had entered into a contract with appellee under the terms of which he, as contractor, obligated himself to furnish all labor and material needed for the construction of a house according to plans and specifications attached to the agreement.
