McGUIRE, Associate Justice.

This is a motion “ * * * for order that deposition shall not be taken” made by the defendant in the above-entitled action, directed at a notice sent out under the provisions of Rule 30, Federal Rules of Civil Procedure, 28 U.S.C.A. following section 723c, which was granted by the court sua sponte, on the ground that the judgment originally obtained was secured in the Municipal Court, and that the plaintiff should further pursue his remedy before that tribunal, under the provision of its rules.
