Defendant in error will be designated as plaintiff and'the plaintiff in error as defendant, as they appeared in the trial court. Plaintiff alleges in his petition that he is a broker, dealing in oil and gas leases, and defendant engaged his services, as broker, and agreed to pay plaintiff five per cent, commission on the purchase of leases produced by plaintiff, and plaintiff hereafter and under fhe agreement procured and was the procuring cause of defendant purchasing certain holdings off the Sebastian Oil Producing Company, for the sum of $31,820, and plaintiff sues to…
