This is a negligence action for damages for personal injuries brought against the City and County Savings Bank of Albany, hereinafter referred to as the bank, M. Gerber Construction Company, Inc., referred to as Gerber, and a partnership known as Sano-Rubin Construction Company, referred to as Sano-Rubin, on the ground that each had been negligent in the construction and maintenance of a wooden barricade erected on the sidewalks of public streets in the city of Albany.
