COMBS, Justice.

This appeal is from a judgment entered on a directed verdict at the close of opening statements by the attorneys. The judgment is in the amount of $2,375 in favor of R. S. Motte against James H. Brinton.

In 1948 Lester Douglas owned the Douglas Auto Parts and Machine Shop in the City of Louisville. In October of that year he entered into a written contract with Motte, a real estate broker, whereby Motte agreed to sell the business for him.
