MOTZ, District Judge.
Plaintiff Birdsong Tractor and Supply, Inc. (“Birdsong”) has brought this action on behalf of itself and others similarly situated against defendant Microsoft Corporation (“Microsoft”). The complaint alleges: 1) monopolistic practices and price fixing in violation of the Arkansas Deceptive Trade Practices Act (“ADTPA”), 2) negligence, and 3) unjust enrichment. Pending before me are several motions briefed by the parties before this case was transferred to this district pursuant to 28 U.S.C. § 1407 in December 2003.
