Edwin Marious Bertsch, petitioner herein, seeks a writ of habeas corpus under 28 U.S.C.A. Section 2241.

As petitioner had not exhausted State remedies on three allegations of constitutional dimension1 found in his application, his petition was placed in inactive status on the docket of this Court pending his presentation of those issues to the Court of Criminal Appeals of Texas. In its Memorandum and Order of February 3, 1965, 242 F.Supp. 52, this Court suggested that petitioner utilize the procedure provided by Article 119, Texas Code of Criminal Procedure, and if…
