The Kilgore State Bank of Kilgore, Nebraska, was insolvent, and through petition filed by the attorney general in district court of the sixteenth district its insolvency was duly declared by the court, and Fred A. Cumbow was appointed receiver. The receiver classified the claim of the United States Fidelity & Guaranty Company for $22,000, the same being the claim here in question, as a “ general claim not having priority.” Thereupon, by leave of court, the surety company intervened and, alleging that the claim was both a claim. of first priority against all the assets…
