ORDER AND AMENDED OPINION

NOONAN, Circuit Judge:

ORDER

The opinion filed on September 15, 2000 [224 F.3d 1157] is amended as follows:

Slip op. p. 1159,1.9, add: “Alternatively, voluntarily remaining in the country after an involuntary entry satisfies the statute.”

Slip op. p. 1159, 1.7, add: “Apprendi argument. Quintana’s argument that Apprendi v. New Jersey, 530 U.S. 466, 120 S.Ct. 2348, 147 L.Ed.2d 435 (2000), overruled Almendarez-Torres v. United States, 523 U.S. 224, 118 S.Ct. 1219, 140 L.Ed.2d 350 (1998), fails. See United States v. Pacheco-Zepeda, 234 F.3d 411 (9th Cir.2000).”
