This was an action by the appellees against the appellants, to contest the .validity of the supposed last will and testament of Walter Hayes, deceased.
The will in question bears date March 9th, 1866, and purports to have been duly signed by the testator,, and to have been attested by Henry Brachman, John P. Massard, and Carter Gazlfey. Before the commencement of this action, the will had been duly proved, and the executors named therein had táken upon themselves the duties of the trust.
