The mayor of the city of St. Charles, acting by the direction of the city council, filed a petition in the court below for a mandamus to compel the Chicago Great Western Railway Company to construct a bridge or viaduct over its railway track at Third street in said city, in accordance with the plans and specifications which had been theretofore approved by the city council “ or such other suitable, safe and convenient crossing as may meet the approval of the city council of said city, and that such further order may be made in the…
