Appellants, Kernel Dawkins and Doris Mae Dawkins, appeal from the judgment of sentence of the Court of Common Pleas, Criminal Section, of Philadelphia County. On January 18, 1968, appellants were arrested and charged with disorderly conduct and resisting arrest. At a preliminary hearing on January 29, Magistrate Edward Quinn refused to decide the summary charge of disorderly conduct and held appellants for indictment on the charge of resisting arrest.
