FAHY, Circuit Judge.
The District Court on motion dismissed a complaint filed by Capital Transit Company (Transit) against Safeway Trails, Inc. (Safeway) to obtain an injunction against certain competitive bus operations of Safeway alleged to be illegal. 1 2 The dismissal order recited that the complaint was premature because plaintiff had not first exhausted available administrative remedies under the Interstate Commerce Act, 49 U.
