OPINION

PETTINE, District Judge.

This is a tort action. The plaintiff, Cynthia D. Marcus, a minor, brings her action by and through her next friend and parent, Joseph E. Marcus. The plaintiff alleges that while exercising due care as a passenger on a motorcycle operated by Philip A. Alpert, the defendant backed his automobile from the driveway onto the street causing said auto to collide with the motorcycle as a result of defendant’s negligence.
