On April 12, 2005, petitioner, Thomas A Belchak, filed a motion to intervene in the ease of State of Utah v. Kennecott Corp., 801 F.Supp. 553 (D.Utah 1992), and to set aside a Consent Decree entered by this Court on August 21, 1995. Plaintiff, State of Utah, filed opposition to Mr. Belchak’s motion to intervene on April 29, 2005.
