Appeal from a judgment of the superior court for King county, Gay, J., entered April 30,1912, upon the verdict of a jury rendered in favor of the plaintiff, in an action for wrongful death.

This is an action by the administrator for the benefit of the widow and minor children of the decedent, to recover damages from the defendant railway company for its alleged negligence resulting in the decedent’s death. The evidence introduced by the plaintiff fairly established the following facts: The decedent was a common laborer, about thirty-five years of age, a native of Bulgaria, and had resided in this country but about twenty-six months.
