Plaintiffs, trustees, and a stockholders’ committee for 6% guaranteed preferred stockholders of Kansas City, St. Louis and Chicago Bailroad Company (hereinafter “ Kansas City ”) appeal from two orders of Special Term: (1) dated April 19, 1951, denying plaintiffs’ motion for summary judgment, and (2) dated April 27,1951, granting defendants’ motion for summary judgment as to the first cause of action for alleged breach of contract and judgment on the pleadings as to the second cause of action for alleged unjust enrichment, and giving leave to plaintiffs to replead the second cause of action.…
