When this case was decided I indicated a purpose, as soon as the other business of the Court would permit, to express my views more fully upon the question of the power of the Legislature, under the Constitution, to make an assessment for street improvements assessed upon the basis of benefits to the property affected, a personal charge upon the owner, and to authorize its collection by suit and personal judgment, as well as by sale of the land benefited.
