delivered the unanimous Opinion of - the Court:

On February 7, 1938, the respondent, Metropolitan Life Insurance Company, issued a policy of insurance to John Jones whereby, in consideration of the premiums therein stated, it agreed, upon proof of his death, to pay to Nellie Jones, as beneficiary, the sum of $115.00. The policy contained a clause, wherein it was provided, among other things, that it was voidable by the company if within two years prior to the date of issue, the insured had been attended by a physician, unless it was shown by the claimant that such…
