— This is an appeal from an order and judgment settling and allowing a receiver’s report and account. The record comes to us containing the receiver’s amended petition and final report, findings and judgment of the court and a bill of exceptions. The action out of which this litigation arose was commenced in the district court of Bingham county in 1899. In that action a receiver was appointed to take charge of certain placer mining properties situated in the Carriboo mining district, Bingham county. W. H.
