DORE, Judge.

This suit is to recover damages on account of injuries received by plaintiff in an automobile accident on the Old Spanish Trail Highway about four miles east of the Sabine river bridge on March 9, 1935, between the hours of 7 and 7:30 p. m.

Plaintiff alleges that she was riding as a passenger in a car driven by Jno. W. Plummer and was proceeding in a westerly direction on said highway on the right-hand side of the road and traveling at a speed of forty miles per hour.
