ORDER DENYING AND GRANTING MOTIONS FOR SUMMARY JUDGMENT

WINDER, Chief Judge.

This matter is before the court on plaintiffs and defendant’s cross-motions for summary judgment on the issue of whether plaintiffs complaint is precluded by Utah’s workers’ compensation statute.
