delivered the opinion of the court.

This is an action on the case by tenants against a landlord. Appellants seek to recover for damages to a stock of goods alleged to have been damaged by rainwater coming through a defective roof. A general demurrer to the declaration was sustained by the Circuit Court, and, appellants electing to stand by their declaration, the suit was dismissed at appellants’ costs. The question presented by this appeal is the sufficiency of the declaration.
