Plaintiff sues to recover $380 damages for the breach of a written contract made by defendant on April 16, 1902, and which was, in substance, as follows: The defendant empowered plaintiff to sell for him a quarter section of land “for the sum of $2,500 net, to be paid upon the terms as follows: As per contract *626to suit purchaser. * * * The right is reserved to revoke this agency in writing after November 1st, 1902.
