MEMORANDUM OPINION AND ORDER DENYING IN PART AND GRANTING IN PART THE TRUSTEE’S MOTION FOR SUMMARY JUDGMENT

This matter is before the Court on the Chapter 7 trustee’s Complaint to Compel Turnover of Trust Assets. The complaint seeks the turnover of property held in self-settled living revocable trusts established by the debtors for their own benefit, including property that has been scheduled by the debtors as exempt under Kansas law. The trustee contends he is entitled to summary judgment on the complaint because the property held in trust is bankruptcy…
