This appeal is from an order of the Orphans’ Court of Baltimore City dismissing a caveat filed by the appellant to the last will of Theodore S. Bantz. The bill was admitted to probate in common form without contest on June 15th, 1904, and the caveat was filed, on September 21st, 1906, within the three years allowed by sec. 33 of Art. 93 of the Code of 1904, for filing caveats to wills.
