Appeals (1) from an order of the Supreme Court (Simone, Jr., J.) in favor of defendant Greenhill Cemetery Association, entered August 31, 1989 in Montgomery County, upon a dismissal of the complaint at the close of plaintiff’s case, and (2) from the judgment entered thereon.
