TURNER, District Judge.

Pursuant to the federal Declaratory Judgment Act, 28 U.S.C. § 2201, and the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1101, et seq., Baptist Memorial Hospital (“BMH”) requests that this court declare the rights and obligations of BMH and the Bakery and Confectionery Union and Industry International Health Benefits Fund 1 (the “Fund”) with respect to $356,984.57 in hospital charges incurred by David Marsaw, deceased, during a lengthy inpatient admission.
