We have here presented for consideration cross appeals from a judgment in plaintiff’s favor in an action for breach of contract against the City of New York. The plaintiff appeals on the ground that the amount awarded is inadequate and the defendant cross-appeals from the entire judgment.

*211The gravamen of the plaintiff’s complaint is the refusal of the city to issue permits for the plaintiff — a private water company furnishing water to the Flatbush area of Brooklyn under a franchise — to hook up five new wells to its distribution system.
