Before the Court is a Motion for Partial Summary Judgment (“Motion”) (ECF No. 44) filed by Defendant South County Hospital Healthcare System (“Defendant”), in which it contends that the federal statute on which this action is premised — the Emergency Medical Treatment and Active Labor Act (“EMTALA”) — does not apply to the hospital facility at issue in this case. Plaintiffs filed an Opposition. (ECF No. *24149.) For the reasons that follow, Defendant’s Motion is DENIED.
