The Connecticut Railway and Lighting Company, the predecessor in title of the defendant, having a franchise from the State for the construction and operation of a railway in certain streets in the city of Waterbury, submitted to the city authorities a plan for exercising this franchise with respect to some of these streets, pursuant to General Statutes, § 3823.
