The appellants, Valance U. Slater and Ross Slater, were jointly indicted in three counts; the first count charged embezzlement of three promissory notes executed by one Homer Mossburg and the property of Belle Debra; the second count charged the embezzlement of $280 collected by the defendants as agents of Belle Debra; the third count charged the defendants with obtaining the notes referred to in the first count by false pretense; on motion of the defendants this count was quashed.
