The action is to recover the purchase price of large quantities of milk alleged to have been sold and delivered to the defendants between March 15 and April 1, 1936. In addition to denials, the defendants’ amended answer sets forth as a first defense that the plaintiff at the time of the transactions in question was a milk dealer, as defined by the Agriculture and Markets Law, and was not licensed to buy or to sell milk within the State of New York.
