In this divorce case the defendant, Jehangir Vazifdar, appeals an order of the Superior Court (Manias, J.) denying his motion to dismiss. The issue presented is whether the superior court abused its discretion in exercising jurisdiction over the parties’ marital status rather than deferring that issue to the Parsi Matrimonial Court of India.
