The question submitted is whether the plaintiffs’ bill (or action at law, if they are permitted to amend) can be maintained; or, in other words, whether a cause of action unknown to the common law, and which exists only by reason of a local law of the state of Kansas, can, or ought to be, enforced in this jurisdiction.
