OPINION

WILLIAM Y. ALTENBERGER, Bankruptcy Judge.

This matter is before the Court on crossmotions for summary judgment. The facts giving rise to this adversary proceeding have been set forth in two previous opinions, In re KZK Livestock, Inc., 221 B.R. 471 (Bankr.C.D.Ill.1998) and In re KZK Livestock, Inc., Case No. 91-82986, 2000 WL 33950835 (Adv. No. 95-8069) (J. Altenberger, Unpublished, June 6, 2000). The latter opinion pertains to various pretrial issues raised by the parties in anticipation of trial.
