The plaintiff, Sterling C. Bush, sought modification of a 1983 divorce judgment. The plaintiff’s complaint, as amended, sought sole legal custody of R.B., the parties’ minor retarded son, a transfer of the equity in the marital home, held since the divorce in joint tenancy subject to the plaintiff’s right of occupancy, to a trust for the benefit of the minor retarded son, and the elimination of the plaintiff’s alimony obligation. 1 The probate judge granted the plaintiff’s request for sole legal custody but refused to order the defendant, Virginia V.
