MEMORANDUM AND ORDER
KOPF, Chief Judge.
This matter is before the court on Defendant’s motion for summary judgment (filing 31). Upon careful consideration of the pleadings, filed affidavits, and briefs submitted by the parties, 1 I find that the motion should be granted.
I. BACKGROUND
This diversity action involves a medical malpractice and wrongful death claim against a physician who was qualified under the Nebraska Hospital-Medical Liability Act, Neb.Rev.Stat.
