This cause was certified to this court by the Springfield Court of Appeals pursuant to Section 6, Article VI, of the Constitution — Amendment of 1884. The action was brought by the seller under a contract of sale against the buyer for the damages which the parties to said contract had stipulated should be recoverable for a breach. At the conclusion of the plaintiff’s case in chief the trial court indicated that it would direct a verdict for the defendant, whereupon plaintiff took an involuntary nonsuit with leave.
