Although I believe that the record before us would support a finding of good cause to grant Garcia’s presentence motion to withdraw plea, I am comfortable joining the majority’s decision to remand the case to permit the district court to rule on the motion in the first instance, utilizing the correct legal standards in the exercise of its judicial discretion.
