Plaintiff is engaged in business as a public utility supplying water to the city of Utica and communities in its vicinity. Under an order dated June 28, 1933, the defendants constituting the Public Service Commission directed the plaintiff to reduce its rates for water service by the sum of approximately $120,000 per year. Thereafter on July 14, 1933, the plaintiff applied to the Commission for a rehearing, which was denied on August eighth of that year.
